including but not limited to its corporate website, online Store and
all online help centers, tutorials, and demos (jointly the "Website"),
is controlled by these Terms of Use. By accessing and using any
Website, you are agreeing to be legally bound by and to comply with the
terms contained in this Terms of Use Agreement. If you do not agree to
these terms, you should refrain from reviewing information or using the
Website.
General
By using the Website, you ("User") are representing to VIPER ("Company"), the publisher and operator of the Website,
that User is at least 18 years old (or the minimum legal age in the
jurisdiction in which you are viewing the Website). User may not use
the Website for any unlawful purpose. Company may change any provision
in this Terms of Use Agreement at any time without notice. Once the
changes appear in this Terms of Use Agreement, User's use of the
Website after the posting of any changes will constitute User's
agreement to the modified terms. User may print a copy of the Terms of
Use Agreement for reference.

User agrees to provide full and accurate information when required to use the
Website or any Website feature. All information is maintained
according to Company's strict privacy policy. User represents and
warrants that all information provided to Company is true and correct.
Warranty Limitation
Except where otherwise expressly provided in writing, User agrees that
use of the Website is "as is" with no express or implied warranty of
any kind. User assumes the risk of using the Website and all Website
content, including but not limited to all text, data, files, tools,
pages and features of any kind ("Content").
Modification of Terms of Use
User understands and agrees that Company may discontinue or change the
Website at any time, without notice. Also, User understands and agrees
that Company may discontinue or restrict User's use of the Website for
any reason without notice.
Copyright Protection
The content displayed on the Website ("Content") is the property of
Company or its licensors, and is protected by US and international
copyright and other intellectual property laws. Unless expressly
authorized in writing, copying or reproduction of Content is strictly
prohibited.
Links to Other Sites
The Website contains hyperlinks to websites operated by third parties.
The hyperlinks are provided for the benefit of the users of the
Website. A hyperlink to a third party website does not imply that
Company endorses the content on or the business activity of the
hyperlinked website, unless the website belongs to a company designed
by VIPER as a "VIPER Partner".
Except for the websites of our VIPER Partners, User
is solely responsible for determining the integrity and reliability of
the information on the hyperlinked website.
Limitation of Liability
Except as otherwise identified in a specific written Customer
Agreement, by using the Website, User is agreeing that under no
situation is VIPER responsible for a) any
information contained in, displayed on or omitted from the Website or
the website of any VIPER Partner, b) any person's
reliance on any such information, whether or not the information is
correct, current or complete, or c) the consequences of any action User
or any other person takes or fails to take, whether or not based on
information provided by or as a result of the use of the Website.
In no event shall VIPER be liable for any indirect,
incidental, special or consequential damages, resulting from the use or
the inability to use the Website or for cost of procurement of
substitute goods and services or resulting from any goods or services
purchased or obtained or messages received or transactions entered into
through the Website or resulting from unauthorized access to or
alteration of User's transmissions or data, including but not limited
to, damages for loss of profits, use, data or other intangible, even if
the center has been advised of the possibility of such damages. In the
event VIPER is found liable, the liability to user
or any third parties is limited to $25. Some jurisdictions do not allow
the limitation or exclusion of liability for incidental or
consequential damages so some of the above limitations may not apply to
User.
User Indemnification
User agrees to indemnify, hold harmless and defend Company from all
reasonable expenses it incurs, including reasonable court costs and
legal fees, enforcing its rights under this Terms of Use Agreement upon
a violation of the agreement.
